IMPORTANT: Voter Registration Clarification
The Town of Brentwood Board of Elections have been fielding questions stemming from confusion around the town charter on voter registration and eligibility. The Board has been consulting with the National League of Cities, election law experts at the Brennand Center for Justice, the Prince George's county board of elections, and the Town of Brentwood Town Attorney to find clarity on these issues.
The following is our current interpretation of the law as stated in the Town Charter and Maryland Election Code. The Board will be working with the Town Administrator to revise any communications already posted regarding the election and are planning on distributing literature this coming weekend. Voter RegistrationAll residents MUST register to vote and submit requests to Absentee vote by Monday, April 10, 2023 at 8pm. Forms are available on the Town website and at town hall.A voter registration table will be at the Town of Brentwood Easter Egg event on Thursday, April 6, 2023 from 4 PM-7PM and at Town Hall Monday, April 10, 2023 from 7 AM-8 PM.Election-Day (same day) registration is not permitted by Town Charter Section 506.1While the state has a provision for this, it is only possible because the state and county board verifies eligibility through MVA in real time. If they are unable to verify with MVA, the voter casts a provisional ballot. We do not have a system to verify with MVA (we would have to pay the county to have them send personnel for this) nor do we have an ordinance for provisional ballots
Section 506.3 and 506.5 allow voters to register by mail or online with the state/county after the cut off, but they must provide proof of registration and eligibility to vote based on section 501.
Voting EligibilityOne (1) year residency is not required to register, but is required and validated before votingSection 501 specifies 1 year residency requirement for votingSection 506.2 does not include the residency requirement to register
Write-In CandidatesAnyone campaigning as a write-in candidate must submit a petition with 20 signatures and be approved by the ethics committeeWrite-in candidates campaigning without submitting a petition can be disqualified
If there are no petitions to be a write-in candidate, other write-ins will be considered and their eligibility will be evaluated based on the Town Charter
